Picture Removal Policy for the Smalltown Lowdown

Numerous times are we asked to remove someone’s picture from our website.  Since our entire reason for starting this magazine and website is to have fun and show others having a good time.  We never go into an establishment without getting permission from the Owners or Managers to take pictures in a location to begin with. 

The federal law also states “In the United States, anyone may take pictures of what ever they want when in a public place or where they have permission to do so.  Members of the public have a very limited scope of privacy rights when they are in public places.”  Basically anyone can be photographed without their consent except when they have a reasonable expectation of privacy such as in a dressing room, rest rooms, medical facilities, and inside their own homes. 

Despite misconceptions to the contrary, the following subjects can almost always be photographed lawfully from public places. 

Accident & Fire Scenes
Children
Celebrities
Residential & Commercial Buildings
Criminal Activities
Law Enforcement Officers

Now, with the legal mumbo-jumbo out of the way.  This site is about fun, if you do not wish to be on this site, then we probably don’t want you on this site either.  If you see one of our photographers in a bar or club taking pictures and do not wish to be photographed, please let them know.  It is much easier to make sure you’re not in the shot then it is to go through a gallery after the editing, watermarking and uploading process has been completed.  Remember, we have a staff that we are paying to go through this process, and your excuse of “I was too drunk” doesn’t really make a difference to us. No matter how many times our editors use this excuse, we still remember how Rob caught the clap.

Also, if do not want your picture taken, a simple “No Thank You” will be acceptable.  Remember, we are usually asked by the establishments to come in and take pictures.  We’re not doing this because we hoard the shots and compile collages of you and your girlfriends to sell on DVD.. Wait, now there’s an idea!    

If you’re out at the club cheating on your significant other, it’s probably better to let us know before we take the picture, not two months later when your Husband/Wife finds the picture on the web.  We’ve had many people come up saying just that “I’m here with my girlfriend/boyfriend and my wife/husband doesn’t know”. No joke.  We even had one woman come up and say “My ex-husband loves your magazine and I just caught him cheating on me, can you take a picture of me with this HOTT guy grabbing my butt and print it in your magazine.”

If we have a reasonable reason to remove your picture, then we will.  This can’t happen in one hour either.  So if you contact us asking to have your picture removed, give us a day or two, you don’t need to call or send an email every few hours.  If you are the person in the picture is the only way we will remove it.  If you want a picture of your girlfriend/wife – boyfriend/husband removed, you’ll have to get over the fact that he/she was out having fun.

If you come up to us and ask us to take your picture, or you see us taking pictures and play-up for the camera, don’t expect your picture to be removed when you sober up.  Remember, our time is valuable and we’d love to be getting drunk with you, rather than driving around having to stay sober and take pictures of your drunken debauchery all night long.  This is what After-Hours is for, and if you can stay sober enough to make it to one of our after-hours parties, feel free to take our pictures all you want.  We’ll happily take our tops off, go shirt-for-shirt, or pose on your bikes all you want, just ask nicely.
